1. SCOPE

These terms apply to all SillySanta products purchased on SillySanta.uk. Please read these terms carefully before submitting your order. When purchasing products, you have accepted and approved the applicable conditions. The latest version of these terms is published on our website and applies to all purchases made on our website.

 

To order from SillySanta.uk, you must have a delivery address in the United Kingdom. All prices are listed in GBP and include VAT. Shipping costs are added if the order is below the free shipping threshold.

 

To shop with us, you must be over 18 years of age or have consent from a parent/legal guardian. When using Klarna, Klarna's own age limits and credit assessment apply.

3. AGREEMENT

The agreement between the customer and the seller consists of the information that the seller has provided about the purchase through the online store (the nature, quantity, quality, price and delivery conditions of the goods) and any direct correspondence between the parties.

 

A legally binding contract is only formed when we accept your order via an order confirmation sent by email. Should we be unable to accept your order – for example, if the product is not in stock, due to unexpected resource limitations, or because we have identified an error in the price – we will inform you in writing. In that case, no contract will be formed, and we will refund any payment made.

 

We only deliver to addresses in the United Kingdom.

4. PAYMENT

We never store payment information and only work with trusted payment companies such as Klarna and PayPal to handle payment transactions. The entire online store is SSL-encrypted for extra security. We who run SillySanta.uk have no opportunity to see your card number or other sensitive information.

 

All prices include VAT but exclude shipping costs. You will be informed of the total amount due before placing your order.

 

Card payment:

We accept Visa and Mastercard. You must pay for the goods before we ship them to you.

 

Klarna:

In cooperation with Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden, we offer the following payment methods: Invoice (14-day payment period), Klarna Account (instalments), Pay Direct (direct debit) and Bank Transfer. Payment always goes directly to Klarna. For more information and Klarna's terms of use, please refer to Klarna's website. The use of personal data is regulated in accordance with Klarna's privacy policy.

 

PayPal:

You can pay using your PayPal account or by card via PayPal if you don't have an account. PayPal is one of the world's leading online payment operators.

 

Retention of title:

The delivered goods remain the property of SillySanta AS until full payment has been received.

5. SHIPPING AND DELIVERY

Standard delivery: £3.99 – Free shipping on purchases above £50

Carrier: Evri

Delivery time: 2–3 working days

 

Express delivery: £5.99 – Free shipping on purchases above £150

(seasonal offer – available during the Christmas season only)

Carrier: Royal Mail

Delivery time: 1–2 working days

 

Express delivery orders placed before 1:00 pm on a weekday are usually dispatched the same day. Express delivery orders placed after 1:00 pm on a Friday, or at any time on Saturday or Sunday, will be dispatched on the next working day (Monday).

 

SillySanta.uk delivers throughout the United Kingdom. You will receive a tracking number as soon as your order has been dispatched from our warehouse. Orders are usually dispatched within 24 hours on weekdays. Delivery may take a little longer during high traffic periods, such as Black Friday. All goods are sent directly from our warehouse in Birmingham.

 

When our warehouse has packed your order and made it ready for dispatch, we will send you an update via email.

 

As a customer, you are responsible for monitoring the status of your shipment. SillySanta.uk is not responsible for issuing a notification about the arrival of your package.

 

If delivery is delayed by an event beyond our control, we will contact you as soon as possible. If there is a risk of a significant delay, you may contact us to terminate the contract and obtain a refund for goods you have paid for but not received.

 

Failed or refused deliveries:

If you fail to pick up the goods, refuse to receive them, or if the package cannot be delivered due to incorrect/missing labelling, the goods will be returned to us. A fee of £20 will be deducted from the amount paid to cover our actual costs at return (shipping both ways and handling). Any remaining amount will be credited back to you. To avoid incorrect delivery, please provide the correct name, address and postcode, and ensure your mailbox is marked with the same name as the order.

 

6. PRE-ORDER (PRESALE)

From time to time, we offer pre-orders on selected products. This means you reserve and pay for the item before it is in stock with us. The estimated delivery time is clearly stated on the product page and in the order confirmation.

 

We recommend checking your order confirmation carefully to see if your order contains pre-order items. The estimated delivery date may change due to delays or other events beyond our control. If there is a significant delay, you will be notified by email.

 

If your order contains both in-stock items and pre-order items, we will normally ship the entire order together once the pre-order item becomes available.

 

You can cancel a pre-order at any time before the item is dispatched and receive a full refund. After dispatch, the standard 14-day cancellation right and 100-day returns policy apply.

 

7. PRODUCT INFORMATION

SillySanta.uk always does its best to provide you with correct product information. We reserve the right to:

  • Display incorrect product descriptions
  • Stock errors
  • Other circumstances that may affect product availability or information

 

8. SPECIAL OFFERS ("2 for 1", "3 for 2" etc.)

With offers such as "2 for 1", "3 for 2" and similar promotions, you receive the cheapest item for free.

 

Returns and refunds: If you return one or more items from an offer, the entire discount or part of it lapses. The items you keep will be charged at the regular sales price. To receive the full refund for the offer, all items that were part of the offer must be returned.

 

Example of "2 for 1":

Two products cost £40 and £30 respectively – you pay £40 in total. If you return the cheaper item (£30), you do not receive a refund. If you return the more expensive item (£40), you receive £10 back and pay £30 (full price) for the item you keep. If you return both items, the full amount is refunded.

 

9. CANCELLATION RIGHT AND RETURNS – 100 DAYS

We offer a 100-day returns policy from the day you received your package. This includes the statutory 14-day cancellation right under the Consumer Contracts Regulations 2013, and is an extension on our part.

How returns work:

  • Fill in the return form on our Returns & Exchanges page and follow the instructions.
  • The return cost of £5.95 is automatically deducted from the refund amount.
  • Would you like a different item? Simply place a new order in our webshop.

All information can be found on our Returns & Exchanges page. Please have your order number and the email address linked to your order ready. Refunds are issued no later than 14 days after we have received your return.

 

Conditions for returns:

The item must be returned in the same condition as when you received it – unused, in its original packaging, with all tags attached, and without any odours or marks. The package label must be included with the return.

 

If the tags have been removed, the seal is considered broken, and the item is no longer in its original condition. The same applies to items with odours, marks or other signs of use. When an item is not in its original condition, we cannot resell it, and a reduction in value occurs. In such cases, we will, as a general rule, deduct 50% of the purchase price when refunding. Each case is assessed individually, and we evaluate the condition of the item on a case-by-case basis.

 

Exception to the right of withdrawal: Personalised products, for example embroidered pyjamas, cannot be returned. This applies to products that have been manufactured according to the customer's specifications or have a clearly personal character, in accordance with the Consumer Contracts Regulations 2013, Regulation 28(1)(b).

 

10. FAULTY OR DEFECTIVE GOODS

We do our best to deliver your goods completely error-free. Have you nevertheless received a product that does not match the description or does not meet the expected standard? Please contact us at hi@sillysanta.uk within a reasonable time, and we will help you. For faster help, please attach photos and a description of the problem.

We comply with the Consumer Rights Act 2015. The statutory period for raising a complaint is up to 2 years from delivery for faults that were present at the time of receipt.

 

Faulty goods cover manufacturing defects or faults that were present at the time of receipt, for example incorrect seams, holes or colour errors.

 

Faulty goods do not cover:

  • Normal wear and tear from regular use
  • Damage caused by misuse or inadequate care (e.g. incorrect washing)
  • Damage caused by accidents after receipt of the item
  • Modifications or alterations made by the customer

We recommend following the washing instructions on the garment to avoid damage that is not covered.

 

In the case of an approved complaint, we will offer a new product (replacement), a partial refund or a full refund – depending on the nature of the case.

 

11. DISCOUNT CODES

Multiple discount codes cannot be combined with each other unless otherwise stated. Each code has its own validity period, which is stated at issuance.

 

12. PRIVACY

SillySanta AS processes personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. You can find our full privacy policy at sillysanta.uk/pages/privacy-policy.

 

13. DISPUTE RESOLUTION

Complaints should be submitted to the seller within a reasonable time, see points 9 and 10. The parties shall attempt to resolve any disputes amicably. If this is not possible, you can contact Citizens Advice (citizensadvice.org.uk) for free guidance, or use an Alternative Dispute Resolution (ADR) scheme.

 

Consumers in the UK may also use the small claims court for unresolved disputes.

 

14. GOVERNING LAW

These Terms and Conditions, and any agreement between SillySanta AS and the customer, are governed by the laws of England and Wales. This does not affect the mandatory consumer protection rights you have under the laws of your country of residence.

 

15. COPYRIGHT

Content on www.SillySanta.uk is the sole property of SillySanta AS and is protected by copyright, marketing and trademark laws. Trademarks, company names, product names, product information, images, designs and layout cannot be downloaded, copied or used in any other way without permission by legislation or consent from SillySanta AS.

 

16. SEVERABILITY

If any provisions of these Terms and Conditions are or become invalid or unenforceable, in whole or in part, this shall not affect the validity of the remaining provisions.
